Terms of Use

Welcome to lovemaddily.com (the "Site"), operated by Love, Maddily ("I," "me," or "my"). These terms govern your use of the Site and any products or services offered through it. By using the Site, you agree to them. If you don't agree, please don't use the Site.

I may update these terms. Significant changes will be posted here and communicated to subscribers by email. Continuing to use the Site after an update means you accept the revised terms.

1.0 Using the Site

1.1 You must be at least 13 years old to use the Site, or 16 if you're a resident of the EU. If you're under 18, a parent or guardian needs to agree to these terms on your behalf.

1.2 Don't use the Site to do anything illegal.

1.3 Don't upload viruses or malware, or interfere with how the Site works.

1.4 Don't do anything that affects how other people use and enjoy the Site. Be a good neighbor.

1.5 Don't post anything violent, hateful, sexual, or degrading toward another person. If you wouldn't say it to someone's face, don't say it here.

1.6 Don't post other people's private information — contact details, addresses, locations. This can be a criminal offense in some states.

1.7 Don't post content that isn't yours or that infringes someone else's intellectual property.

1.8 Don't use bots or automated tools to scrape the Site or send unwanted messages.

1.9 Use your common sense and be a good human.

I may remove content or restrict access for anyone who breaks these rules.

2.0 Your Content

2.1 What this section covers. This section applies only to content you post publicly or send me informally — blog comments, testimonials, emails, social replies, and similar. It does not apply to photographs, documents, or materials you share with me as part of a paid service. Those are governed by Section 5.0 and by my Privacy Policy, and I claim no rights to them.

2.2 Content you post publicly on the Site isn't confidential and may be visible to others.

2.3 If you send me a testimonial or public comment, you give me permission to share it — on the Site, in the newsletter, or on Pinterest — with your first name or initials. You can ask me to remove it at any time and I will.

2.4 By submitting content, you confirm it's yours to share and that it isn't illegal, defamatory, or harmful.

2.5 You can ask me to delete content you've submitted, or any personal information I hold, by emailing hello@lovemaddily.com. Some records may persist where I'm legally required to keep them.

3.0 My Content

3.1 Everything on the Site — writing, photographs, graphics, templates, podcast episodes, the Love, Maddily name and marks — belongs to me or my licensors and is protected by copyright and trademark law.

3.2 You're welcome to share links to my content, quote briefly with attribution, and print things clearly offered as printable for your own family's use. You may not reproduce, republish, or redistribute my content, in whole or substantial part, without written permission.

3.3 Podcast episodes may be shared through normal podcast platform functions. Please don't re-upload, re-edit, or transcribe episodes for republication elsewhere.

3.4 Copyright complaints. If you believe your copyright is being infringed, email hello@lovemaddily.com or write to 2110 Artesia Blvd. #582, Redondo Beach, CA 90278. Your notice must comply with the DMCA.

4.0 Digital Products

When you buy a template, printable, guide, or other digital product, you're buying a license to use it — not ownership of the design.

4.1 What you can do. Use it for your own family, as many times as you like. Print as many copies as your household needs. Fill it in, write in it, adapt it for your own use.

4.2 What you can't do. Resell it, give away the file, share it in a group or membership, upload it anywhere others can download it, sell physical copies made from it, incorporate it into a product you sell, or claim the design as your own.

4.3 Professional use. If you'd like to use a product with your own clients — as a photo organizer, doula, therapist, or similar — that needs a separate license. Email me and I'll sort something out.

4.4 Delivery and access. Digital products are delivered by download or email link after purchase. If a file won't download or arrives corrupted, tell me and I'll fix it. If I discontinue a product, existing purchasers keep access for at least 90 days.

4.5 Refunds. Because digital products are delivered immediately and can't be returned, all sales are final. If something is wrong with a file, or you received the wrong item, contact me within 30 days and I'll make it right.

In plain terms: it's yours to use with your family forever. It just isn't yours to sell or hand out.

5.0 Services

This section applies if you hire me for memory coaching, photo organization, book design, or similar work.

5.1 Scope and agreement. Services are described in a separate proposal or service agreement, which controls if it conflicts with anything here.

5.2 Your materials stay yours. Photographs, documents, recordings, and physical items you share with me remain your property. I claim no ownership and no license to use them beyond completing your project. I will not publish or display them without your specific written permission.

5.3 Your rights to what you share. By sharing materials, you confirm you have the right to do so, including for photographs of other people.

5.4 Physical materials. Where original physical items are involved, I scan them before they travel, ship by tracked and insured methods, and keep them secure while in my care. Shipping carriers are outside my control, and my liability for loss or damage in transit is limited to the declared insured value. Irreplaceable originals travel at your discretion.

5.6 Payment. Terms are set in your proposal. Deposits are non-refundable once work has begun. Invoices unpaid more than 15 days past due may accrue interest at 1.5% per month, and accounts unpaid more than 60 days may be referred to collections.

5.7 What I'm offering. Coaching and organizing services help you build systems and make decisions about your own family's history. I don't guarantee any particular outcome, and you remain responsible for your own choices about what to keep.

6.0 Affiliate Links, Recommendations, and Testimonials

6.1 Some content contains affiliate links, meaning I may earn a commission at no extra cost to you. I disclose these relationships and only recommend products I've personally used.

6.2 I'm not responsible for third-party products, services, or purchases made through affiliate links. Review their terms before buying.

6.3 Testimonials reflect individual experiences and don't guarantee similar results.

7.0 Not Professional Advice

Nothing on the Site is legal, medical, financial, or therapeutic advice. Content about memory keeping, family history, and the emotional side of documenting a life is offered for general information and encouragement.

7.1 On caring for photographs and materials. I share what I've learned about preserving family things — the supplies I've tested, the storage methods I use, the research I've read. I'm not a trained archivist or conservator, and what I offer is a well-informed starting point, not professional guidance.

If something is fragile, deteriorating, or genuinely one-of-a-kind — a photograph that's beginning to break down, a damaged film reel, the only surviving copy of a document — please talk to a conservation professional before doing anything to it. The American Institute for Conservation keeps a searchable directory of qualified professionals at culturalheritage.org. Some things deserve better than a well-meaning DIY attempt, mine included.

7.2 On the harder parts of this work. Memory keeping sits close to grief, illness, family conflict, and loss. Sorting a parent's photographs after they're gone is not a filing project, and it often doesn't feel like one.

If this work brings up more than you were expecting, that's an ordinary response to something genuinely hard — and it's worth having support that isn't a website. Psychology Today's directory is a good place to start looking for a therapist, and you can filter by grief and loss specifically.

In plain terms: I'm a thoughtful guide, not a licensed anything. Check your sources, and get real help when you need it.

8.0 Limits on Liability

8.1 The Site is provided as is. I can't guarantee it will always work perfectly or be free of errors. TO THE EXTENT PERMITTED BY LAW, LOVE, MADDILY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8.2 TO THE EXTENT PERMITTED BY LAW, LOVE, MADDILY IS NOT LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS PRODUCTS. SOME JURISDICTIONS DON'T ALLOW THESE EXCLUSIONS, AND IN THOSE PLACES THAT LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW.

8.3 My total liability to you is limited to the greater of $100 or the amount you paid me in the twelve months before the claim. For paid services, liability is limited to the amount you paid for that project.

8.4 I'm not responsible for third-party sites, tools, or services linked from the Site, or for what other people say or do online.

8.5 You agree to indemnify me against claims arising from your breach of these terms or your misuse of the Site, including reasonable attorney's fees.

In plain terms: if something goes wrong, there's a cap on what I owe. It's roughly what you paid me. If you break the rules and it costs me money, that's on you.

9.0 Dispute Resolution

9.1 Disputes will be resolved by binding arbitration under the American Arbitration Association. You waive the right to a jury trial or to participate in a class action.

9.2 Small claims matters, intellectual property disputes, and collections may proceed in court.

9.3 These terms are governed by California law, and any court proceedings will take place in California.

10.0 Final Provisions

10.1 Third-party terms may apply when you use external services linked from the Site.

10.2 If any part of these terms is unenforceable, the rest still applies.

10.3 You may not transfer your rights under these terms without my consent.
